1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the services provided by EdTecQ Sdn Bhd (“EdTecQ,” “we,” “our,” or “us”), including our websites, mobile applications, educational content platforms, and APIs (“Services”).

By accessing or using any part of our Services, whether as an individual user, parent, educator, school administrator, or organization, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

 

2. Eligibility

To use our Services:

  • Children under the age of digital consent (13 under COPPA, 16 under GDPR, 20 under Thailand PDPA) must have verifiable parental, guardian, or institutional consent prior to accessing the Services.

  • If you are an educational institution, NGO, or government body, you are responsible for ensuring that all users under your supervision have appropriate consent in compliance with applicable data protection laws.

  • By accessing the Services on behalf of a school or organization, you represent and warrant that you are authorized to bind the entity to these Terms.

     

3. Permitted Use

You may use EdTecQ’s Services for:

  • Educational, non-commercial, research, or developmental purposes

  • Internal instructional or administrative use by educators and schools

  • Authorized integration through API or SDK under separate agreement
     

You may not:

  • Attempt to reverse engineer, decompile, modify, or redistribute our software or content

  • Use the platform to collect unauthorized data from students or users

  • Circumvent access controls or security features

  • Sell, lease, sublicense, or commercially exploit the Services or data derived from it without explicit written approval from EdTecQ

We reserve the right to monitor usage for abuse or policy violations.

 

4. Intellectual Property

All intellectual property rights in the content, source code, platform architecture, algorithms, graphics, user interfaces, and documentation made available via the Services are owned by EdTecQ Sdn Bhd or its content licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. This license does not grant you any rights to modify, reproduce, or create derivative works from the content or system components.

 

5. Account Management and User Responsibilities

  • You are responsible for the accuracy of information you provide and for maintaining the security of your login credentials.

  • If you suspect any unauthorized use of your account, you must notify us immediately.

  • Schools or organizations are accountable for managing user access, data permissions, and consent records for students under their supervision.

  • You agree to use the Services in a manner that complies with all applicable laws, including local education regulations and child protection frameworks.

     

6. Modifications and Updates

EdTecQ may update these Terms periodically to reflect changes in laws, platform features, or business practices. We will make reasonable efforts to notify users of material changes via email or on-platform notifications.

Continued use of the Services after such modifications constitutes your acceptance of the revised Terms. If you do not accept the changes, you should stop using the Services.

7. Suspension and Termination

We reserve the right to suspend or terminate access to any user, school, or partner platform, without prior notice, if we determine that:

  • These Terms have been violated

  • There is misuse, abuse, or unauthorized use of the Services

  • Legal or policy requirements necessitate action

Upon termination:

  • All licenses granted under these Terms will be revoked

  • User data may be retained, anonymized, or deleted in accordance with our Privacy Policy and legal obligations

     

8. Compliance and Governing Law

This agreement shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in Malaysia for any legal action arising out of or related to the Services.

To the extent applicable, EdTecQ complies with:

  • COPPA – U.S. Children’s Online Privacy Protection Act

  • GDPR – European General Data Protection Regulation

  • Thailand PDPA – Personal Data Protection Act B.E. 2562

  • Other relevant data protection regulations in jurisdictions where our Services are used
